1. Each applicant ("Member"), by acknowledging these terms and conditions or by using the membership card agrees to be bound by these Backyard Rewards Club Membership Terms and Conditions. City Farmers Franchising Pty Ltd (ACN 083012211), operators of the Backyard Rewards Club Program, and the "Backyard Rewards Club Program" means those arrangements by which a member collects points by purchasing qualifying goods and services from participating retailers and thereby qualifies for rewards. Participating retailers means those retailers from time to time participating in the Backyard Rewards Club Program by supplying goods and services in respect of which points will be credited.
2. The Member acknowledges that under the Backyard Rewards Club Program;
a) The relevant participating retailer is solely responsible for the payment of the reward upon redemption of points and City Farmers accepts no liability for the payment of rewards.
b) Members may redeem points upon acquiring a total of 200 points, and can redeem points only in multiples of 200. Further rewards may be offered in redemption of points at levels greater than 200 points as determined from time to time by the participating retailer.
c) Points will be credited on purchase of qualifying goods and services at a rate to be determined from time to time.
d) Rewards will be in the form of a discount, gift or gift voucher and of a character, nature and value to be determined by the participating retailer and may vary from time to time. Rewards are not redeemable for cash and can only be claimed at the relevant retailer.
e) City Farmers may in its absolute discretion terminate a Member's participation, cancel or bring forward the expiry date of any points, make changes to the Terms and Conditions, and suspend or terminate the Backyard Rewards Club Program.
f) The Backyard Rewards Club Card and points are not transferable and any redemption of points will not be available until after the 24 hour validation period.
g) Points will expire 24 months from the date that points were credited to the Member’s Backyard Rewards Club Card.
3. Members acknowledge the following regarding Family Cards:
a) One member only is nominated as the master Master Card holder, with any other members carrying Associate Cards.
b) The Master Card holder is the sole receiver of the redeemed points, and all points from Master and Associate Cards in the family will accrue to the Master Card account.
c) The Master Card number must be quoted to request information on points balance.
d) Family members can accrue points on Associate Cards, but points can only be redeemed by presentation of the Master Card.
4. City Farmers shall not be liable in any way whatsoever for any failure of equipment or delay in crediting points relating to any particular transaction to the Backyard Rewards Club Member.
5. No conditions or warranties except those implied and which cannot be excluded by law are given by City Farmers in respect of the award of points and any goods or services supplied upon redemption of points. Where it is lawful and practical to do so, the liability of City Farmers for breach of a condition or warranty shall be limited to the re-supply of Backyard Rewards Club points.
6. Each Backyard Rewards Member is responsible for advising City Farmers of any change of address or email address. Notwithstanding the above, City Farmers may inform, advise and notify Backyard Rewards Members by any form of communication.
7. Lost, stolen or damaged Cards should be reported to the City Farmers National Support Office on 08 9345 7200 or via email. At its absolute discretion, City Farmers may issue a replacement Card. Any points assigned to the lost, stolen or damaged Card will be cancelled; however, City Farmers may upon request transfer these points onto the replacement Card.
8. Your Card is issued by and remains the property of City Farmers. City Farmers reserves the right, at any time without notice, to:
a) decline to issue Cards;
b) on reasonable grounds, withdraw or cancel Cards, entitlements, points or other benefits;
c) terminate a cardholder's membership in the Backyard Rewards Program; or
d) terminate the Backyard Rewards Program.
9. Reasonable grounds for withdrawal or cancellation include:
a) any abuse or attempted abuse of the Card or the Backyard Rewards Club Program;
b) any use or attempted use of a Card, entitlement to offers or other benefits in a manner contrary to these Terms and Conditions;
c) any use or attempted use of a Card, entitlement to an offer or other benefits for purchases made by a person (other than the primary Cardholder or any linked Family Card Member);
d) any reasonable suspicion of dishonesty of a Cardholder in connection with the Backyard Rewards Club Program
e) any tampering or defacing or unauthorized use of a Card will render the Card invalid.
10. City Farmers is not responsible for the delay in replacing a lost, stolen or damaged Card – nor any loss, theft or damage to any documentation in the course of post or delivery of that documentation.
11. City Farmers respects your privacy. We collect, store and use your personal information in accordance with the Privacy Act 1988. You consent to City Farmers using your personal information to operate and provide you with membership benefits of the City Farmers Backyard Rewards Program (including related communications) and to bring you other membership benefits. You also consent to City Farmers using your personal information to assist in planning, developing and researching product and service offerings. For example, we may:
a) seek your participation (on a purely voluntary basis) in advertising campaigns, launches, customer testimonials, product testing and focus groups; and
b) seek your feedback on the Backyard Rewards Program, City Farmers advertising campaigns and City Farmers product and service offerings.
City Farmers has relationships with third parties to whom we make disclosures of your personal information in connection with such uses. You consent to City Farmers disclosing your personal information to those with whom we have service arrangements (these may include mailing houses, printers and agencies) and to those with whom we have alliance arrangements, where our disclosure is for the purpose of the above uses to which you consent.

12. City Farmers reserves the right to change, suspend or terminate these Terms and Conditions at any time in its absolute discretion without giving a reason and without notice.
